Matthew Allen Berry, 25, Pierz, was charged with one felony count each of first degree criminal sexual conduct – penetration or contact with a person under 13 and the perpetrator being more than 36 months older; first degree criminal sexual conduct – penetration or contact with a person under 13, the victim under 16, and the perpetrator having a significant relationship with the victim; second degree criminal sexual conduct – the victim under age 13 and the perpetrator more than 36 months older; and second degree criminal conduct – with a victim under 16 years old and the perpetrator having a significant relationship with the victim.
On Jan. 27, The Morrison County Sheriff’s Office learned about the sexual assault of Berry’s 4-year-old child.
Deputies interviewed the child, using protocols for interviewing young children, and learned Berry allegedly assaulted the child, with his girlfriend present.
An interview with the girlfriend allegedly confirmed an incident occurred prior to Feb. 23, 2011, at the defendant’s mother’s residence.
If convicted, Berry, who is a registered sex offender, faces a maximum penalty of 30 years imprisonment and/or a $40,000 fine.
