Morrison County District Court

The following people, charged with a misdemeanor or gross misdemeanor level crime in Morrison County District Court, have recently been sentenced:

Gross Misdemeanors

• Jason Andrew Borash, 21, Rice; (offense: 12/24/11) liquor – purchase/sell/barter/furnish/give to under 21-year- old, fined $385, sentenced to 12 days in jail and supervised probation for two years. Dismissed against Borash was one misdemeanor count of fourth degree DWI – operating a motor vehicle under the influence of alcohol; one misdemeanor count of fourth degree DWI – operating a motor vehicle with an alcohol concentration of 0.08 within two hours; and one misdemeanor count of open bottle.

• Paul Raymond Borash, 36, Bowlus; (offense: 5/17/12) fourth degree DWI – operating a motor vehicle with an alcohol concentration of 0.08 within two hours, fined $450, sentenced to 15 days in jail and supervised probation for two years. Dismissed against Borash was one gross misdemeanor count of third degree DWI – operating a motor vehicle under the influence of alcohol.

• Ryan John Schuett, 42, Little Falls; (offense: 11/19/11) liquor – purchase/sell/barter/furnish/give to under 21-year- old, fined $385, sentenced to 30 days in jail and supervised probation for two years.

• Russell Dale Patraw, 56, Little Falls; (offense: 5/5/12) third degree DWI – operating a motor vehicle with an alcohol concentration of 0.08 within two hours, fined $565, sentenced to 10 days in jail and supervised probation for four years. Dismissed against Patraw was one gross misdemeanor count of third degree DWI – operating a motor vehicle under the influence of alcohol.

• Bradley Darwin Posterick, 22, Little Falls; (offense: 6/18/12) obstructing legal process – interfering with peace office, fined $385, sentenced to 12 days in jail and supervised probation for two years. Dismissed against Posterick was one count of fourth degree DWI – operating a motor vehicle under the influence of alcohol; one misdemeanor count of fourth degree DWI – operating a motor vehicle with an alcohol concentration of 0.08 within two hours and misdemeanor count of driving after revocation.

Misdemeanors

• Nicholas Joseph Wittmann, 26, Little Falls; (offense: 11/04/11)  animal ordinance – unlawful to mistreat animal, fined $50, unsupervised probation for one year.

• Simon Gene Potter, 21, Minneapolis; (offense: 9/27/11) DWI – operating a motor vehicle under the influence of alcohol, fined $410, sentenced to 45 days in jail and supervised probation for two years. Dismissed against Potter was one count of DWI – refusal to submit to chemical test.

• Jorge Antonio Valencia-Avalos, 35, Motley; (offense: 3/10/12) fourth degree DWI – operating a motor vehicle with an alcohol concentration of 0.08 within two hours, fined $560, sentenced to three days in jail and supervised probation for two years. Dismissed against Valencia-Avalos was one gross misdemeanor count of DWI – operating a motor vehicle under the influence of alcohol.

• Trudy Kay Graves, 55, Royalton; (offense: 4/28/12)third degree DWI – operating a motor vehicle with an alcohol concentration of 0.08 within two hours, fined $1,051, sentenced to 30 days in jail and supervised probation for four years. Dismissed against Graves was one gross misdemeanor count of third degree DWI – operating a motor vehicle under the influence of alcohol.

• Anita Elaine Moody, 48, Pierz; (offense: 5/30/11) damage to property – fourth degree – intentional damage – other circumstances, fined $50, probation to the court for one year.
