Berry sentenced to 54 months in prison for sexual contact with a child

Morrison County District Court Judge Douglas P. Anderson sentenced Matthew Allen Berry to 54 months in prison Wednesday, following his conviction for criminal sexual conduct in the second degree (victim under 13). Berry, 27 of Pierz, pleaded guilty in April 2012. A post-plea series of motions by the defense delayed the sentencing that had originally been set for October, 2012.

The Morrison County Sheriff’s Office opened its investigation in January 2012, regarding the defendant reportedly having sexual contact with a then 4-year-old child. Berry pleaded guilty the day after the child was found to be competent to testify, Assistant Morrison County Attorney Todd Kosovich said. Berry pleaded guilty just days before a jury trial was set to begin.

Berry will be required to register as a predatory offender and will be on conditional release for 10 years after his sentence ends. Violations during a conditional release could result in an additional 120 months in prison being imposed.
