Derek Wayne Pounds, 40, Litle Falls, was charged Oct. 10 in Morrison County District Court with one felony count each of domestic assault by strangulation and domestic assault – intentionally inflicting or attempting to inflict bodily harm.
On Oct. 8, the Morrison County Sheriff’s Office responded to a report of a domestic assault. The victim had gone home and officers observed injuries to her face, nose and neck. The neck injuries were consistent with strangulation.
The victim said she went to Pounds’ residence after they had been to the bar together earlier in the evening. While there, he allegedly pushed her to the ground and choked her to the point that she couldn’t breathe.
When the officers confronted Pounds, he allegedly admitted being with the victim earlier in the evening, but denied injuring her in any way.
According to the criminal complaint, Pounds said he did put his arms around her, picked her up and carried her outside and told her to leave.
Officers allegedly smelled alcohol on Pounds’ breath and he admitted he had been drinking, a violation of his probation. He was placed under arrest.
If convicted, Pounds faces a maximum penalty of three years in prison and/or a $5,000 fine.
