Marx charged with possession of heroin

Randy Lee Marx Jr., 25, Cushing, was charged Aug. 19 in Morrison County District Court with one felony count of fifth degree possession of a controlled substance.

On Aug. 17, when a Little Falls police officer stopped a vehicle with a headlight out, he learned the driver had a suspended license. Marx was seated in the back seat.

A Morrison County deputy arrived on the scene and allegedly observed a small case in the pouch behind the passenger-side front seat. It was directly in front of where Marx was seated.

Inside the case were two hypodermic needles, a small squirt bottle containing what appeared to be water and a small container with a cotton swab inside. The substance in the container field-tested positive for heroin.

Marx allegedly said he had previously used heroin, but denied the case was his.

If convicted, Marx faces a maximum penalty of five years in prison and/or a $10,000 fine.
